ÊVO is a brand operated by Evo Industries LLC ("ÊVO," "we," "us," or "our"). We provide permanent makeup (PMU) and related beauty services, professional training through ÊVO Academy, and an online store and website, including all related information, content, features, tools, products, and services (together, the "Services"). Our online store is powered by Shopify, and certain booking, scheduling, and payment features are powered by third-party providers described below.
This Privacy Policy describes how we collect, use, and disclose your personal information when you visit our studios, book or receive a treatment, enroll in a course, visit or use our website, make a purchase or other transaction, or otherwise communicate with us. If there is a conflict between our Terms of Service and this Privacy Policy, this Privacy Policy controls with respect to the collection, processing, and disclosure of your personal information.
Please read this Privacy Policy carefully. By using or accessing any of the Services, you acknowledge that you have read this Privacy Policy and understand the collection, use, and disclosure of your information as described here.
Personal Information We Collect or Process
When we use the term "personal information," we mean information that identifies or can reasonably be linked to you or another person. Personal information does not include information collected anonymously or de-identified so that it cannot identify or be reasonably linked to you. Depending on how you interact with the Services, where you live, and as permitted or required by applicable law, we may collect or process the following categories of personal information, including inferences drawn from it:
- Contact details including your name, address, billing address, shipping address, phone number, and email address.

We collect this information to confirm your eligibility, to perform your treatment safely, and to care for you before and after your appointment.
- Photographs and images including photos of your face, treated area, or other relevant areas taken before, during, and after your treatment for your records and our quality standards, and, where you have given your consent, for use in our portfolio, marketing, and educational materials. See Photographs and Media below.
- Financial information including credit card, debit card, and financial account numbers, payment card information, transaction details, form of payment, payment confirmation, deposit and retainer records, and, if you use a payment plan, information you provide to our financing partners.
- Account information including your username, password, security questions, preferences, and settings.
- Booking and appointment information including the services you view or book, your appointment times and history, deposits and retainers, cancellations and reschedules, and related communications.

- Communications with you including the information you include when you contact us by text, email, phone, social media, or through the Services, for example when sending a support inquiry.
- Device information including information about your device, browser, or network connection, your IP address, and other unique identifiers.
- Usage information including information about your interaction with the Services, such as how and when you navigate or use them.
Personal Information Sources
We may collect personal information from the following sources:
- Directly from you, including when you book an appointment, complete an intake or consent form, create an account, visit or use the Services, communicate with us, or otherwise provide us with your personal information.
- Automatically through the Services, including from your device when you use our products or services or visit our websites, and through cookies and similar technologies.
- From our service providers, including when we engage them to enable technology, booking, payments, or other functions, and when they collect or process your personal information on our behalf.
- From our partners or other third parties.
How We Use Your Personal Information
Depending on how you interact with us and which Services you use, we may use personal information for the following purposes:
- Provide treatments and services safely. We use your health, treatment, and booking information to confirm you are eligible and suitable for a treatment, to perform your treatment safely, to maintain your treatment records, to provide aftercare, to schedule and manage your appointments, deposits, and retainers, and to follow up with you.
- Provide, tailor, and improve the Services. We use your personal information to provide the Services, perform our contract with you, process payments, fulfill orders, remember your preferences, send account-related notifications, process purchases, returns, exchanges, and other transactions, create and manage your account, arrange shipping, enable reviews, and create a customized experience.
- Photographs and portfolio. We take before, during, and after photographs as part of your treatment record. We use these images for your records and our standards. We use them in our portfolio, marketing, or educational materials only where you have given your consent, and you may decline or withdraw that consent as described below.
- Marketing and advertising. We use your personal information for marketing and promotional purposes, such as to send marketing and promotional communications by email, text message, or postal mail, and to show you online advertisements, including based on items you previously purchased or added to your cart and other activity on the Services. See Text Messaging below for how SMS marketing works.
- Security and fraud prevention. We use your personal information to authenticate your account, provide a secure payment and booking experience, and detect, investigate, or act on possible fraudulent, illegal, unsafe, or malicious activity, protect public safety, and secure our Services. If you register an account, you are responsible for keeping your credentials safe, and we recommend you do not share your username, password, or access details with anyone.
- Communicating with you. We use your personal information to provide customer support, respond to you, deliver the Services, and maintain our relationship with you.
- Legal reasons. We use your personal information to comply with applicable law or valid legal process, including requests from law enforcement or government agencies, to investigate or participate in litigation or other legal proceedings, and to enforce or investigate potential violations of our terms or policies.
Health and Treatment Information
Permanent makeup and related services require us to collect sensitive health information so we can keep you safe. We treat this information as confidential. We use it to assess your eligibility, perform your treatment, and provide aftercare, and we share it only with the people and providers who need it to serve you, or as otherwise described in this Privacy Policy or required by law. We do not sell your health or treatment information, and we do not use it for third-party targeted advertising. ÊVO is generally not a "covered entity" under HIPAA, so that law may not apply to our records; regardless, we handle your health and treatment information with care.
Photographs and Media
As part of your treatment record, we take photographs of the relevant area before, during, and after your appointment. These images are kept with your records. We use your images in our portfolio, on social media, in marketing, or in educational and training materials only with your consent, which we ask for separately (for example, through a photo or media release). You may decline consent, or withdraw it for future use, by contacting us using the details below; withdrawing consent does not affect uses already made or copies already shared. Some images, such as facial photographs, may be considered biometric or sensitive information under certain state laws, and we handle them accordingly.
Text Messaging (SMS)
If you provide your mobile number and opt in, we may send you text messages related to your appointments, bookings, aftercare, and, where you have agreed, marketing and promotions. Message and data rates may apply, and message frequency varies. Consent to receive marketing texts is not a condition of any purchase or service. You can opt out of marketing texts at any time by replying STOP, and reply HELP for help. Opting out of marketing texts does not stop non-promotional messages about your account, appointments, or treatments.
How We Disclose Personal Information
In certain circumstances, we may disclose your personal information to third parties for legitimate purposes subject to this Privacy Policy, including:
- With Shopify, our booking and scheduling provider, and other vendors and service providers who perform services on our behalf (e.g., online store hosting, appointment booking and scheduling, payment processing, data analytics, customer support, cloud storage, fulfillment, and shipping).
- With payment and financing partners that you choose to use, such as our card processor and payment-plan providers (for example, Cherry, Afterpay, or Sezzle). When you apply for a payment plan, you provide information directly to that provider, and it uses your information under its own privacy policy.
- With business and marketing partners to provide marketing services and advertise to you. For example, we use Shopify to support personalized advertising with third-party services based on your online activity with different merchants and websites. Our partners use your information under their own privacy notices. Depending on where you reside, you may have a right to direct us not to share information about you for targeted advertising. You can exercise those rights here.
- When you direct, request, or consent to our disclosure of certain information to third parties, such as to ship you products or through your use of social media widgets or login integrations.
- With our affiliates or otherwise within our corporate group.
- In connection with a business transaction such as a merger, acquisition, or bankruptcy; to comply with applicable legal obligations (including subpoenas, search warrants, and similar requests); to enforce our terms or policies; and to protect or defend the Services, our rights, and the rights of our users or others.
Relationship with Shopify
Our online store is hosted by Shopify, which collects and processes personal information about your access to and use of the store in order to provide and improve it for us. Information you submit to the store will be transmitted to and shared with Shopify as well as third parties that may be located in countries other than where you reside, in order to provide and improve the Services. To help protect, grow, and improve our business, we use certain Shopify enhanced features that incorporate data and information obtained from your interactions with our store, along with other merchants and with Shopify. In these circumstances, Shopify is responsible for processing your personal information, including responding to your requests to exercise your rights over that use. To learn more, see the Shopify Consumer Privacy Policy. Depending on where you live, you may exercise certain rights here: Shopify Privacy Portal.
Third-Party Websites and Links
The Services may provide links to websites or other online platforms operated by third parties, including our booking, payment, and financing providers and our social media. If you follow links to sites we do not control, you should review their privacy and security policies and other terms. We do not guarantee and are not responsible for the privacy or security of such sites, including the accuracy, completeness, or reliability of information found on them. Information you provide in public or semi-public venues, including on third-party social networks, may be viewable by others without limitation as to its use. Our inclusion of such links does not imply endorsement.
Children's Data
Our Services are intended for adults. Our treatments are available only to clients 18 years of age or older, and the Services are not directed to children. We do not knowingly collect personal information from children under the age of majority in your jurisdiction. If you are the parent or guardian of a child who has provided us with personal information, you may contact us using the details below to request deletion. As of the effective date of this Privacy Policy, we do not have actual knowledge that we "share" or "sell" (as those terms are defined in applicable law) the personal information of individuals under 16 years of age.
Security and Retention of Your Information
Please be aware that no security measures are perfect or impenetrable, and we cannot guarantee "perfect security." Any information you send to us may not be secure while in transit, and we recommend that you do not use unsecure channels to communicate sensitive or confidential information to us.
How long we retain your personal information depends on factors such as whether we need it to maintain your account, provide the Services, maintain treatment and safety records, comply with legal, tax, or insurance obligations, resolve disputes, or enforce our contracts and policies.
Your Rights and Choices
Depending on where you live, you may have some or all of the rights below in relation to your personal information. These rights are not absolute, may apply only in certain circumstances, and in certain cases we may decline your request as permitted by law:
- Right to Access / Know. You may have a right to request access to the personal information we hold about you.
- Right to Delete. You may have a right to request that we delete personal information we maintain about you.
- Right to Correct. You may have a right to request that we correct inaccurate personal information we maintain about you.
- Right of Portability. You may have a right to receive a copy of your personal information and to request that we transfer it to a third party, in certain circumstances and with certain exceptions.
- Right to Opt Out of Sale or Sharing for Targeted Advertising. Depending on where you reside, you may have a right to opt out of the "sale" or "share" of your personal information, or of processing for "targeted advertising" as defined in applicable privacy laws. You can exercise those rights here. If you visit our website with the Global Privacy Control (GPC) signal enabled, depending on where you are, we will treat it as a request to opt out for that device and browser, and where we can associate it with a Shopify account, we will apply the opt out to the account as well. To learn more about GPC, visit https://globalprivacycontrol.org/. Other than GPC, we do not recognize other "Do Not Track" signals.
- Managing Communication Preferences. You may opt out of promotional emails at any time using the unsubscribe option in our emails, and out of marketing texts by replying STOP. If you opt out, we may still send non-promotional messages about your account, appointments, or orders.
You may exercise these rights where indicated on the Services or by contacting us using the details below. To learn more about how Shopify uses your personal information and any rights you may have, visit https://privacy.shopify.com/en.
We will not discriminate against you for exercising any of these rights. We may need to verify your identity before processing your request, as permitted or required by law. You may designate an authorized agent to make requests on your behalf; before accepting such a request, we will require proof of authorization and may need to verify your identity directly. We will respond within the time required by applicable law.
Complaints
If you have complaints about how we process your personal information, please contact us using the details below. Depending on where you live, you may have the right to appeal our decision by contacting us, or to lodge a complaint with your local data protection authority.
International Transfers
We may transfer, store, and process your personal information outside the country you live in. If we transfer your personal information out of the European Economic Area or the United Kingdom, we will rely on recognized transfer mechanisms such as the European Commission's Standard Contractual Clauses, or equivalent contracts issued by the relevant UK authority, unless the transfer is to a country determined to provide an adequate level of protection.
Governing Law
The Services are operated from the United States, and this Privacy Policy and any dispute relating to it are governed by the laws of the State of Florida and applicable United States federal law, without regard to conflict-of-laws principles, except where applicable data protection law requires otherwise.
Changes to This Privacy Policy
We may update this Privacy Policy from time to time, including to reflect changes to our practices or for other operational, legal, or regulatory reasons. We will post the revised Privacy Policy on this website, update the "Last updated" date, and provide notice as required by applicable law.
